1. Scope and Contract Formation
These Terms and Conditions apply to all contracts between Batsmanluno GmbH, Jakominiplatz 14, 8010 Graz, represented by Managing Director Johanna Bauer, and its clients regarding the provision of instrument building and maintenance services.
A binding contract is established when a client submits a request via the contact form at /en/contact.html or by telephone at 0316 80 77 35, and Batsmanluno GmbH confirms the order following an initial assessment.
2. Services and Pricing
Prices quoted in offers are based on the workshop's current rates. All final prices include the statutory VAT of 20%. Detailed price lists are available on the Services page.
The initial diagnosis of the instrument is provided free of charge (0 €). Before commencing any work, the client will receive a detailed cost estimate. Should unforeseen defects arise during the repair process, the client will be notified immediately and a revised estimate will be submitted for approval.
3. Payment Terms and B2B
Private clients are required to settle the agreed amount immediately upon completion of the work and at the time of instrument collection.
For business customers (B2B), a payment term of 30 days from the invoice date applies. In the event of default, we reserve the right to claim default interest. Billing is conducted in accordance with the provisions of the DPA, where applicable to the cooperation.
4. Appointments, Cancellations, and Changes
Agreed appointments are binding. If a client is unable to attend, notification must be provided at least 24 hours in advance. In the case of short-term cancellations or no-shows, we reserve the right to charge a processing fee.
Changes to the order specifications during the work process may extend the delivery time and lead to additional costs, which will be invoiced separately.
5. Warranty and Liability
We grant a warranty of 6 months on the specific work performed by us. This warranty refers exclusively to the craftsmanship of the repair or adjustment, and does not cover the general condition of the instrument or wear-and-tear parts (e.g., strings).
Liability for slight negligence is excluded to the extent permitted by law. We are not liable for damages resulting from improper handling of the instrument after delivery. For further details, please refer to our Disclaimer.
6. Instrument Storage and CITES
The client will be notified upon completion of the work. The instrument will be stored free of charge in our climate-controlled workshop for a period of 14 days. After this period, storage fees may apply.
In accordance with international agreements (CITES), we do not perform work on instruments containing materials from protected species (e.g., ivory, Brazilian rosewood) unless valid legal documentation is presented.
7. Final Provisions and Jurisdiction
The laws of the Republic of Austria apply. The provisions of the Consumer Protection Act (KSchG) and the Distance and Off-Premises Contracts Act (FAGG) remain unaffected.
The place of jurisdiction for all disputes arising from this contractual relationship is Graz. Should any provision of these terms be invalid, the validity of the remaining provisions shall remain unaffected.
